Terms of Service

1. Acceptance of Terms

By accessing or using Cody AI Recruiter (“the Service”), operated by Cody AI Ltd (“we”, “us”, “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Cody AI Recruiter is an AI-powered recruitment platform that connects marketing professionals with employers. The Service includes:

  • AI voice agents (Cody for candidates, Harper for employers) powered by ElevenLabs
  • AI-powered candidate profiling and job matching
  • Employer search and shortlisting tools
  • Account management and authentication via Supabase

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your account credentials. Employer accounts require a valid company email address; personal email providers (Gmail, Yahoo, Hotmail, etc.) are not accepted for employer accounts.

4. Candidate Terms

As a candidate, you agree that:

  • The Service is free to use and will remain free for candidates
  • Information you share in voice conversations with Cody will be processed by AI to build your candidate profile
  • Your profile data (skills, experience, salary expectations, preferences) may be shared with employers who use the platform
  • You can request deletion of your data at any time by contacting us
  • AI-generated profile summaries and skill extractions may contain inaccuracies — you should review and update your profile

5. Employer Terms

As an employer, you agree that:

  • You will use candidate data solely for legitimate recruitment purposes
  • You will not share, resell, or redistribute candidate data obtained through the platform
  • The Service is currently free for all employers during early access. Pricing may be introduced in the future with advance notice
  • A 3-month guarantee applies: if a hire leaves within 3 months, we will provide replacement candidates at no cost
  • AI match scores and recommendations are advisory — you are responsible for your own hiring decisions

6. Voice Conversations

Voice conversations with Cody and Harper are processed by ElevenLabs' Conversational AI. By using the voice agents, you consent to:

  • Your voice being captured and transcribed during conversations
  • Transcripts being processed by AI to extract structured data
  • Conversation data being stored for service improvement and your account records

7. AI Disclaimers

The Service uses artificial intelligence throughout. AI outputs (profiles, match scores, recommendations, summaries) are generated automatically and may contain errors or inaccuracies. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content. Users should verify all AI outputs before making decisions based on them.

8. Prohibited Use

You may not:

  • Use the Service for any unlawful purpose or to discriminate against candidates
  • Attempt to reverse-engineer, scrape, or extract data from the Service
  • Create fake accounts or misrepresent your identity
  • Interfere with or disrupt the Service's infrastructure

9. Intellectual Property

The Service, including its design, code, AI models, and branding, is owned by Cody AI Ltd. You retain ownership of data you provide (CVs, profile information, job briefs). By using the Service, you grant us a licence to process your data as necessary to deliver the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Cody AI Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time. Upon termination, your data will be deleted within 30 days unless retention is required by law.

12. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or a notice on the platform. Continued use after changes constitutes acceptance.

13. Governing Law

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
